In these Terms, when we say “NineID”, “we” or “our”, we mean Nine Engineering BV, a company organized and existing under the laws of Belgium having its registered office at Stapelplein 70, bus 103, 9000 Ghent, Belgium and with company number 0752.969.527 (PRP Ghent, division Ghent).

Please note that our Website and the content available thereon is maintained and made available to the public solely for the purpose of offering, in a convenient manner, insights and information to those who are interested in NineID’s hardware, software and services.

If you wish to purchase any hardware, software or services from us, our commercial Terms and Conditions will govern said purchase. In addition, the usage of our hardware, software and services may be subject to additional terms of use related thereto.

USER RIGHTS

You are entitled to access and use the Website and the content available thereon free of charge, in accordance with these Terms, for personal and non-commercial purposes.

USAGE OF THE WEBSITE

User obligations

By using the Website you agree to:

• comply with any applicable local, national or international regulations, laws and implementing acts, including but not limited to laws regarding trademarks, copyrights, rights of privacy, and defamation;

You may not use, copy, reproduce or obscure in any manner any trademarks, logo’s or similar intellectual or industrial property rights visible on our Website.

You may print copies and download extracts of any of our Website page(s), provided the usage thereof is strictly limited to your personal non-commercial usage. You are not allowed to modify the content of any printed Website page(s) (including, without limitation any illustrations, photographs, video or audio sequences or any graphics or other content available on the Website).

NineID will make commercially reasonable efforts to ensure the continued availability of the Website.

However, NineID does not guarantee that the Website shall be accessible or available at any time, from any geographic area or via each User device. The Website may for example not be available during periods of maintenance carried out by NineID or its hosting provider (which can be either planned or unplanned). In addition, we may suspend, withdraw or restrict the availability of all or any part of our Website for business and operational reasons.

The content of our Website is provided for general information purposes only and is not intended to amount into advice. The Website and content available thereon is solely made available “as is”. Although we endeavour to ensure that the information displayed on our Website is as up-to-date and complete as possible and is an accurate description of our services, hardware and software offered, the information on our Website, including any pictures or video’s may no longer be entirely accurate at the time of your Website visit or purchase. NineID is not responsible for material errors or deviations in any Website descriptions. You may however, at any time contact NineID to receive the most up-to-date information about our services and product offering.

LIMITATION OF LIABILITY

NineID is not responsible or liable for any failure or delay in the performance of its obligations hereunder arising out of or caused by force majeure or outside our reasonable control. In such case NineID will undertake such steps to minimize the effects of the force majeure event.

Subject to the maximum extent permitted by law, NineID shall not be liable to you for any indirect, punitive, special, consequential, or similar damage (including damages for loss of profit, lost revenue, loss of business, loss of corruption of data, loss of goodwill, and reputational damage, incurred due to the usage of the Website or any content available thereon.

CHOICE OF LAW AND FORUM

These Terms shall be governed by and construed in accordance with the laws of Belgium and the Parties hereto submit to the exclusive jurisdiction of the courts of Ghent (division Ghent), Belgium. The foregoing is without prejudice to any consumer’s right to present a dispute before a competent court on the basis of a mandatory statutory provision. 

Before initiating proceedings before the competent courts, you shall exercise reasonable good faith efforts to amicably settle any disputes that might arise during the execution of these Terms.
